Overview
Introduction
These Terms of Service ("Terms") govern your access to and use of Foodly, including the Foodly website, mobile application and related beta prototype services.
By accessing or using Foodly, you agree to these Terms. If you do not agree, you must not use Foodly.
Eligibility
You must be at least 16 years old to use Foodly. If you are under 18, you should use Foodly only with the involvement of a parent or guardian where required by law.
You must not use Foodly if you are prohibited from using the service under applicable law.
Accounts and Security
Some Foodly features require an account. You are responsible for the information you provide, maintaining the security of your account and any activity that occurs through your account.
- Provide accurate account and profile information.
- Keep your login credentials secure.
- Do not access another person's account without permission.
- Notify Foodly if you believe your account has been compromised.
Service and Content
The Foodly Service
Foodly helps users save restaurant links, match social-media posts to restaurants, organise saved places into collections, discover restaurants on a map and share selected collections with others.
Foodly may use third-party services to process submitted links, extract restaurant context, retrieve place information, display maps and provide search or recommendation features.
Restaurant details, ratings, opening hours, locations, source posts and summaries may be incomplete, delayed, inaccurate or generated from third-party information. You should verify important restaurant information directly with the restaurant or original source before relying on it.
User Content
Foodly may allow you to create, upload, submit, save, publish or share content, including profiles, usernames, bios, avatars, collections, notes, comments, reviews, ratings, hypes, follows, submitted links and other restaurant-related information.
You keep ownership of content you own. By submitting content to Foodly, you grant Foodly a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, display, modify for formatting or technical purposes, distribute and otherwise use that content as reasonably necessary to operate, improve and provide Foodly.
If you make content public, you also allow Foodly to display that content to other users and visitors and to use it in public discovery, search, profile, map and collection experiences.
Your Content Responsibilities
You are responsible for the content you submit to Foodly and for ensuring you have the rights needed to submit or share it.
- Do not submit sexual content, child exploitation material, graphic violence or content that encourages self-harm.
- Do not submit content that is unlawful, misleading, defamatory, harassing, hateful, threatening, abusive, invasive of privacy or otherwise harmful.
- Do not submit content that infringes another person's intellectual property, privacy, publicity or other rights.
- Do not submit spam, scams, malware, automated abuse or attempts to manipulate rankings, hypes, reviews or discovery.
- Do not impersonate another person or misrepresent your affiliation with a person, restaurant, brand or organisation.
- Do not use Foodly to collect information about other users without permission.
Third-Party Content and Services
Foodly may display, link to or process content from third-party services such as TikTok, Instagram, Google Places, map providers and restaurant websites. Third-party content and services are not controlled by Foodly and may be subject to separate terms and privacy policies.
Foodly does not claim ownership of third-party creator content. Where Foodly displays or links to third-party content, that content remains the responsibility of the original source or rights holder.
Platform Rules
Acceptable Use
You must use Foodly lawfully and respectfully.
- Do not interfere with, disrupt, scrape, overload, reverse engineer or attempt to gain unauthorised access to Foodly or its systems.
- Do not bypass rate limits, security controls, access controls or account restrictions.
- Do not use automated systems to create accounts, submit content, manipulate engagement or extract data without written permission.
- Do not use Foodly in a way that could harm users, restaurants, creators, Foodly or third-party services.
- Do not use Foodly for unlawful, fraudulent or deceptive activity.
Moderation and Content Reports
You can block users from a content or profile menu and manage blocked users in Settings. While signed in, blocking hides each other's profiles, collections and reviews and pauses collection sharing and access between you. It does not remove access for other collaborators or prevent viewing public content while signed out. Unblocking restores visibility and any existing sharing permissions.
Foodly uses text filtering and moderator review to address objectionable content. We review reports and may restrict content or accounts. These safeguards may not detect every violation. Do not use reports to harass others or submit deliberately false complaints.
Foodly may remove, limit, hide or refuse to display content, suspend accounts or take other reasonable action if we believe these Terms have been breached, content creates risk for users or the public, or action is needed to operate Foodly safely.
Use the in-app report option on collections, profiles, reviews or source posts to report harmful content. Reports are private to authorised moderators. Foodly records the report and a snapshot of the content and may send these details to its moderation inbox for review. You can also contact p84projectfoodly@gmail.com for support or to appeal a moderation decision.
Privacy
Foodly's Privacy Policy explains how we collect, use, store and disclose personal information. By using Foodly, you acknowledge that Foodly will handle information as described in the Privacy Policy.
Beta and Account
Beta Prototype Availability
Foodly is provided as a beta prototype and may be unavailable, incomplete or contain bugs. We may change, suspend or discontinue any part of Foodly at any time.
Foodly is not responsible for decisions you make based on restaurant information, social-media content, generated summaries, rankings, ratings, maps or recommendations shown in the service.
Fees
Foodly is currently offered as a beta prototype without published consumer pricing. If paid features are introduced, Foodly will provide pricing and payment terms before charging users.
Account Deletion and Termination
You may delete your account through the account settings area where available. Foodly may suspend or terminate access if you breach these Terms, create risk, misuse the service or if continued access would expose Foodly or others to legal, security or operational risk.
After account deletion or termination, some provisions of these Terms continue where their nature requires it, including provisions relating to user content already shared publicly, third-party content, disclaimers, limitations of liability and dispute terms.
Legal Terms
Disclaimers
To the maximum extent permitted by law, Foodly is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory.
Foodly does not guarantee that restaurant information, maps, social-media source context, generated summaries, search results, recommendations or public content will be accurate, complete, current, secure or uninterrupted.
Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified under applicable law.
To the maximum extent permitted by law, Foodly is not liable for indirect, incidental, special, consequential or exemplary loss, loss of data, loss of profits, loss of goodwill, service interruption, third-party content, restaurant decisions or reliance on information displayed in Foodly.
Changes to These Terms
Foodly may update these Terms from time to time. The Last updated date shows when these Terms were most recently changed. If a change materially affects your rights or obligations, Foodly will aim to provide appropriate notice.
Governing Law
These Terms are governed by the laws of Australia, without regard to conflict-of-law principles.
